In order to qualify as a dispute resolution professional for the Office of Smart Growth Intergovernmental Land Use Dispute Resolution Program, individuals must meet the minimum criteria for both alternative dispute resolution experience and local government land use planning experience. The criteria for these subject areas are listed below.
Prospective ADR professionals must meet the requirements of both “A” and “B” below. In addition, candidates must also meet the requirement of either “C” or “D” below to satisfy the alternative dispute resolution experience requirements under this Part I.
A. Subscription to Mediators Revised Code of Professional Conduct and the Colorado Model Standards of Conduct for Mediators. In addition, mediators who are attorneys are to be guided by the Colorado Rules of Professional Conduct, when applicable;
AND
B. Active participation in continuing education in the mediation process and in substantive areas;
AND ONE OF THE FOLLOWING:
C. Member in good standing in either the American Arbitration Association (AAA) Roster of Neutrals or the National Association of Securities Dealers (NASD) Dispute Resolution
Pool of Arbitrators/Mediators;
OR
D. Alternative Dispute Resolution Training – Recommended Guidelines for Mediator Education and Training, as set forth by the Colorado Council of Mediators and Mediation Organizations and the Colorado Bar Association:
1. A 21-hour comprehensive mediator training program which covers the first seven skill components described under Divorce and Child Custody Mediation, Model Alternative A, number 1, a. through g., including at least 6 hours of role playing; PLUS training or experience in multiparty dynamics (h):
a. Information Gathering Skills and Knowledge
b. Relationship Skills and Knowledge
c. Communication Skills and Knowledge
d. Problem-Solving Skills and Knowledge
e. Ethical Decision-Making and Values Skills and Knowledge
f. Interaction and Conflict Management Skills and Knowledge
g. Professional Skills and Knowledge
h. Multiparty Dynamics Training or Experience
AND
2. 100 hours of mediation experience (solo or co-mediation) in at least eight different cases while in consultation with an experienced mediator. At least one of the eight cases must be multiparty. One should participate in at least five hours of consultation;
In addition to alternative dispute resolution experience, prospective ADR professionals must also meet minimum requirements for local government land use planning experience. Prospective ADR professionals must meet both requirements listed in “A” and “B” below and at least one of the requirements listed in “C” through “H” to satisfy the requirements of this Part II:
A. Subscription to the American Institute of Certified Planners Ethical Guidelines;
AND
B. Active participation in continuing education in local government land use planning;
AND ANY ONE OF THE FOLLOWING:
C. Law degree from accredited law school and one year of local government land use experience;
OR
D. Masters degree from accredited planning school and one year in practice of local government land use planning;
OR
E. American Institute of Certified Planners Certification;
OR
F. Undergraduate degree in planning or closely related field and five years in practice of local government land use planning;
OR
G. Four years of experience as an elected or appointed local government official dealing with land use issues;
OR
H. Ten years of involvement in local government land use issues.
