The Intergovernmental Land Use Dispute Resolution Program provides a referral network of professionals with experience in alternative dispute resolution and local government land use planning who are available to assist local governments.

One of the duties of the Office of Smart Growth (OSG) is to provide a list of qualified professionals who are available to assist local governments in resolving land use disputes. Under the statute,

“Such list shall include only those persons and organizations the department determines have professional expertise and skills in land use, planning, zoning, subdivision, annexation, real estate, public administration, mediation, arbitration, or related disciplines. Such list shall be made available to governmental entities and the public through the office created by this part 32 for the purpose of facilitating the resolution of disputes between or among local governments arising out of land use matters.”(C.R.S. 24-32-3209)

Beginning in the fall of 2000, OSG convened a work group of local government and alternative dispute resolution experts to establish minimum qualifications and criteria for admittance to this list of qualified professionals. The qualifications detail not only the experience required in alternative dispute resolution, but local government land use planning as well.

How to Use the List of Qualified Alternative Dispute Resolution Professionals

The List of ADR Professionals is maintained by the Office that allows local government officials to find mediation professionals available to mediate conflicts in their area. The Office encourages local governments to request qualifications and check references to help make an informed decision in choosing the right professional for the job.

The Office of Smart Growth is interested in hearing from local government officials who have used the Intergovernmental Land Use Dispute Resolution Program to resolve land use conflicts.
